Japanese–British Divorce: Procedures & Visa Status

Divorce Between Japanese and British Citizens: Procedures and Residence Status in Japan

Which Country’s Divorce Law Applies?

When a Japanese citizen and a British national divorce, the applicable law depends on their nationality and habitual residence.

Under Article 27 of Japan’s Act on General Rules for Application of Laws, Japanese law applies where either spouse is a Japanese national habitually resident in Japan.

Accordingly, Japanese law generally governs divorces between Japanese and British couples living in Japan. Where the couple resides overseas, the applicable law requires further examination.

1. Divorce Procedures in Japan and the UK

Under Japanese law, divorce may be obtained through mutual agreement, family court mediation, judicial determination, or litigation.

Japan permits divorce by mutual consent (Kyogi Rikon), allowing couples to dissolve their marriage by submitting a divorce notification without court proceedings.

In the UK, divorce procedures differ between England and Wales, Scotland, and Northern Ireland.

In England and Wales, a no-fault divorce system allows couples to apply jointly or individually through the courts. A contested court hearing is not necessarily required.

Whether a Japanese divorce is recognized in the UK depends on the relevant legal requirements.

In particular, a Japanese divorce by mutual consent may qualify for recognition under the UK’s Family Law Act 1986, but specific conditions concerning domicile and residence must be satisfied.

A divorce legally effective in Japan is not necessarily recognized automatically in the UK.

Couples should consult a qualified UK solicitor where recognition in both countries is important.

2. Reporting a UK Divorce to Japanese Authorities

After a divorce is finalized in the UK, the Japanese spouse must report it to Japanese authorities so that the divorce can be recorded in the Japanese family register.

The notification may be submitted to the Embassy of Japan in the UK or the relevant municipal office in Japan.

According to the Japanese Embassy’s guidance, where the Japanese spouse was the applicant in the UK divorce proceedings, the notification must generally be submitted within 10 days after the divorce becomes final.

Different filing arrangements may apply where the Japanese spouse was the respondent.

Typical supporting documents include:

  • Japanese divorce notification
  • Certified copy of the Final Order (formerly Decree Absolute)
  • Japanese translation of the Final Order
  • Additional court records and identification documents, where required

Following acceptance, the divorce will be reflected in the Japanese family register.

3. Residence Status After Divorce in Japan

A British national residing in Japan under Spouse or Child of Japanese National status must notify Japan’s Immigration Services Agency within 14 days of divorce.

Divorce does not automatically invalidate the existing residence status. However, the individual no longer meets the underlying marital requirement.

Remaining in Japan without engaging in activities as a spouse for six consecutive months or longer, without a justifiable reason, may constitute grounds for revocation.

British nationals wishing to continue residing in Japan should therefore consider changing to an appropriate residence status promptly.

Depending on their circumstances, possible options include:

Eligibility depends on the applicant’s employment, financial circumstances, family relationships, and residence history.
