Foreign spouses separated due to domestic violence (DV) may receive special consideration for residence status renewal or cancellation in Japan. They may also continue to reside in Japan as permanent residents after divorce under certain conditions.
Residence Status Cancellation
Spouses on a visa may have their residence status revoked if they don’t engage in activities as a spouse for over 6 months without a legitimate reason or don’t report a new address within 90 days of leaving their registered residence. However, if the spouse is temporarily separated due to DV, this may be considered a legitimate reason and their residence status may not be canceled.
Address Confidentiality
For those who don’t want their abuser to know their current address, the local municipality office can provide support measures for DV victims. The abuser will be denied access to the victim’s new address on their residency record.
Residence Status Renewal
DV victims should file for divorce mediation at a family court and submit relevant documents to the Immigration Bureau. If they can explain their situation, their residence status may be renewed. However, if they cannot clearly explain their situation, it may result in a disadvantageous outcome. Consulting with an expert is recommended.
