Changing a Tourist Visa to a Spouse Visa in Japan: Legal Requirements and Exceptions

Japan Immigration Law Update | October 2026

Foreign nationals married to Japanese citizens generally qualify to apply for the residence status known as Spouse or Child of Japanese National, commonly referred to as a Japanese spouse visa.

However, marriage alone does not automatically grant the right to reside in Japan. The appropriate immigration procedure depends on whether the foreign spouse is currently living overseas or already staying in Japan.

A particularly important question is whether a foreign national can enter Japan as a temporary visitor and subsequently change to spouse status.

1. Three Ways to Apply for a Japanese Spouse Visa

There are three principal immigration procedures for foreign spouses seeking to establish residence in Japan.

1. Certificate of Eligibility (COE)

The standard approach is to obtain a Certificate of Eligibility through a qualifying representative in Japan. After receiving the COE, the foreign spouse generally applies for a visa at a Japanese embassy or consulate overseas.

2. Change From Temporary Visitor Status

A foreign spouse already visiting Japan may wish to change to Spouse or Child of Japanese National status without leaving the country.

However, Japanese immigration law restricts such changes, and approval requires exceptional circumstances.

3. Application Through Relatives in Japan

Where both spouses live overseas, a qualifying family member residing in Japan may assist with the COE application.

This approach is particularly relevant to international couples relocating to Japan after living abroad for many years.

2. Can You Change a Tourist Visa to a Spouse Visa?

Under Article 20 of Japan’s Immigration Control and Refugee Recognition Act, changing from Temporary Visitor status to a long-term residence status is generally prohibited unless unavoidable special circumstances exist.

A legally valid marriage to a Japanese national does not, by itself, guarantee permission to change status.

Circumstances that may support an exceptional application include:

  • Pregnancy or serious family-related circumstances.
  • Humanitarian considerations requiring the couple to remain together in Japan.
  • Serious medical conditions or other compelling personal circumstances.
  • Extraordinary travel restrictions caused by disasters or similar events.

These are potential considerations, not automatic grounds for approval.

Applicants should consult the relevant immigration office before submitting an exceptional change-of-status application.

3. What Happens if Your 90-Day Stay Expires?

Temporary Visitor status generally permits stays of 15, 30 or 90 days.

Under certain conditions, applicants who have submitted a qualifying change-of-status application before their authorized stay expires may remain in Japan while the application is examined.

This special period ends on the earlier of the immigration authority’s decision or two months after the original expiration date.

Important: The statutory special-period provision does not apply to applicants whose authorized stay is 30 days or less.

Furthermore, applying for spouse status does not automatically authorize employment while the applicant remains under Temporary Visitor status.

4. Is the Certificate of Eligibility a Better Option?

For most foreign spouses living outside Japan, the COE procedure offers a more conventional immigration route.

It allows immigration authorities to examine the proposed long-term residence before the applicant travels to Japan.

By contrast, changing from Temporary Visitor status requires demonstrating not only eligibility for spouse status but also sufficient exceptional circumstances to justify an in-country change.

Consequently, couples planning to live together in Japan should consider the COE procedure before making travel arrangements.

5. Frequently Asked Questions

Can I stay in Japan after marrying a Japanese citizen?

Marriage does not automatically authorize long-term residence. You must obtain an appropriate residence status, and changing from Temporary Visitor status is subject to special restrictions.

Can pregnancy justify changing to a spouse visa?

Pregnancy may be considered as part of an exceptional-circumstances assessment, but approval is not guaranteed.

Can I apply for a spouse visa during a 90-day visit?

An application may be possible in exceptional circumstances, subject to immigration authority review. The ordinary route for overseas applicants is generally the COE procedure.

Do I need to change my current work visa after marriage?

Not necessarily. Foreign nationals already holding a valid employment-based residence status may continue under that status after marrying a Japanese citizen, provided they continue to satisfy its conditions.
