Change Work or Student Visa to Spouse Visa in Japan
Changing Your Work or Student Visa to a Spouse Visa in Japan
Japan Immigration Law Insights
How Can You Change Your Current Visa to a Japanese Spouse Visa?
Foreign nationals who already reside in Japan under a work visa, student visa, or another residence status may apply to change their status to Spouse or Child of Japanese National after marrying a Japanese citizen.
The procedure is called an Application for Change of Status of Residence (在留資格変更許可申請).
Unlike a Certificate of Eligibility application for individuals living overseas, this procedure is intended for foreign nationals who already hold an eligible residence status in Japan.
1. What Does Immigration Examine?
Japanese immigration authorities assess several factors when determining whether to approve a change to spouse status and whether to grant a one-, three-, or five-year period of stay.
These include:
- The length and authenticity of the marriage
- The stability and continuity of the marital relationship
- Family composition and household financial circumstances
- Previous residence and immigration compliance history
An applicant’s previous immigration history is particularly important.
For example, prolonged absence from school while holding Student status or extended unemployment while holding an employment-based status may raise concerns about compliance with immigration requirements.
Serious violations may result in refusal of the change-of-status application.
First-time spouse status applicants frequently receive a one-year period of stay. A three-year or longer period may be granted during subsequent extensions, depending on their circumstances.
2. What Can You Do After Obtaining Spouse Status?
Unlike ordinary employment-based residence statuses, Spouse or Child of Japanese National generally has no restrictions on employment activities.
Holders may work for a company, establish and manage their own businesses, or engage in independent professional activities.
For example, they may work as YouTubers, social media influencers, freelancers, or entrepreneurs without requiring a separate employment-based residence status.
3. What Questions Are Asked in a Spouse Visa Application?
Japanese immigration authorities require applicants to provide detailed information about their relationship to determine whether the marriage is genuine.
The official spouse visa questionnaire typically addresses:
- When and where the couple first met
- How their relationship developed
- The circumstances leading to marriage
- Whether the couple was introduced by another person
- Previous marriages or divorces
- Important dates and events in their relationship
Applicants generally provide written explanations rather than answering these questions through a routine personal interview.
Photographs of the couple and other supporting evidence are also important in establishing the authenticity of the marriage.
Although these questions may feel intrusive, their purpose is to prevent fraudulent marriages entered into primarily for immigration purposes.
Accurate, consistent explanations and credible supporting documentation are essential to a successful spouse visa application.
